2012 BOMBAY SAPPHIRE® Artisan Series Contest

"OFFICIAL RULES"

  1. ELIGIBILITY: NO PURCHASE NECESSARY. Open only to U.S. residents 21 years of age or older. Void in Utah and Rhode Island, where prohibited or restricted by law, regulation, rule or otherwise. Subject to all applicable federal and state laws and regulations. Contest begins at 12:01 a.m. EST, May 21, 2012 and ends at 11:59 p.m. EST on August 24, 2012.

  2. TO ENTER: To enter online go to www.complex.com/sapphireart, www.juxtapoz.com, http://www.curatedmag.com, www.deviantart.com or www.facebook.com/bombaysapphire and follow the instructions for creating and submitting your visual arts piece. Please complete the online Official Entry Form by entering your full legal name, complete mailing address, daytime/evening phone numbers, e-mail address, and date of birth and attach an image of your visual arts piece in JPEG format (all fields required). Click on the "submit" button to transmit your entry. The visual arts piece submitted must be the exclusive and original work of the entrant. If you do not want your e-mail address used for future marketing and promotional purposes, please leave the opt-in box unchecked on the entry form.

    You may create your visual arts piece in any medium, including using the computer program of your choice, but the image submitted must be in JPEG format in order to be eligible. Use of any computer or computer program is not provided by the Sponsor.

    To enter via mail, clearly and legibly handprint the words: “2012 BOMBAY SAPPHIRE® Artisan Series Contest”, your full legal name, complete mailing address, day/evening telephone numbers, e-mail address (if you have an e-mail address), and date of birth (all information is required) on a piece of paper, and enclose an image of the visual arts piece and mail to:

    Enter as often as you like, but each entry must be submitted separately with a limit of one (1) entry per person per day. All on-line entries must be received by 11:59 p.m. EST, August 24, 2012. All mail-in entries must be postmarked by August 17, 2012 and received by August 24, 2012. Upon submission, all entries and designs become the exclusive property of Bacardi U.S.A., Inc. ("Sponsor") and no entries will be returned.

    Entries not satisfying all the requirements of these Official Rules will be automatically disqualified.

    If you are entering this Contest via Facebook, you acknowledge and agree that this promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. You understand that you are providing your information to Sponsor and not to Facebook. The information you provide will only be used for Sponsor’s future marketing and promotional purposes. Please leave the opt-in box unchecked on the entry form if you do not wish to receive future communications. If left unchecked, the information you provide will only be used for purposes of administering this Contest and in accordance with Sponsor’s privacy policy at www.bacardi.com/global/en/html/legal/#privacy.

  3. VISUAL ARTS PIECE RESTRICTIONS:

    1. All visual arts pieces submitted for this Contest (“Visual Arts Submission”) must comply with the content guidelines set forth in the Code of Responsible Practices for Beverage Alcohol Advertising and Marketing of the Distilled Spirits Council of the United States, Inc. (the “DISCUS Code)”, a copy of which can be found at www.discus.org and otherwise attached hereto.

    2. Any Visual Arts Submission containing the following content will be disqualified:

      1. Copyrights and/or trademarks infringing on the rights of any third party;
      2. Lewd, obscene, profane, pornographic, disparaging, indecent, hateful, violent content or nudity, in violation of the DISCUS Code;
      3. Content that infringes upon or violates the rights of any third party, including any statutory or common law proprietary rights or any other rights;
      4. Content that is otherwise deemed to be inappropriate by Sponsor, in its sole discretion.
  4. SECOND PRIZES: Twelve (12) Second Prize Winners, will each receive a trip to Miami, Florida, as described below, to participate in the 2012 BOMBAY SAPPHIRE Artisan Series Finale Competition in December 2012.

    Each Second Prize Winner will be contacted by the Sponsor or its designee via phone or e-mail to arrange to have each winning Visual Arts Submission(s) shipped (with insurance coverage for the Visual Arts Submission(s) selected by Sponsor in an amount up to $10,000.00) to Miami by November 26, 2012. Any additional insurance coverage above $10,000.00 will be the responsibility of each winner to obtain at its own expense. Each Visual Arts Submission will be returned to the Second Prize Winner on or about December 20, 2012.

    Each Second Prize Winner will win a trip to Miami, Florida consisting of: one (1) round trip coach air transportation for each Second Prize Winner from the major contiguous U.S. commercial airport closest to Second Prize Winner's residence to Miami, Florida; single- occupancy hotel accommodations for two (2) nights; and ground transportation to/from hotel and airport/competition. Air carriers, hotel, and ground transportation will be selected exclusively by Sponsor. Each Second Prize Winner will be responsible for all necessary travel authorizations and any travel insurance. Travel and accommodations are subject to availability and certain restrictions, blackout dates may apply. All travel must start and end within the United States. Each Second Prize Winner must provide hotel with a major credit card issued in his/her name to cover room security and incidental expenses. Sponsor assumes no responsibility for cancelled, delayed, suspended or rescheduled events (including airline flights) beyond its control. If the Second Prize Winner lives within 200 miles of Florida (as determined by Sponsor), Sponsor reserves the right to substitute ground transportation in lieu of airfare at its sole discretion, and any difference in value will not be awarded. The estimated retail value of each second prize is $2,500.00. Total depending on Second Prize Winner’s point of travel origin. Actual value will be determined by Second Prize Winner’s residence and fare fluctuations. Any difference in amount between approximate retail value and actual value (if any) will not be awarded. Estimated aggregate retail value for all Second Prizes: $30,000.00.

  5. GRAND PRIZES: Two (2) Grand Prize Winners will be selected from the twelve (12) Second Prize Winners attending the 2012 BOMBAY SAPPHIRE Artisan Series Finale Competition taking place in Miami, Florida in December 2012. Each Grand Prize Winner will display each of their winning Visual Arts Submission(s) at Rush Arts Gallery in New York City during the month of February 2013. Each Grand Prize Winner will receive a trip to New York, New York consisting of: one (1) round trip coach air transportation for each Grand Prize Winner from the major contiguous U.S. commercial airport closest to Grand Prize Winner's residence to New York, New York; single occupancy hotel accommodations for two (2) nights; and ground transportation to/from hotel and airport/art gallery. Air carriers, hotel, and ground transportation will be selected exclusively by Sponsor. Each Grand Prize Winner will be responsible for all necessary travel authorizations and any travel insurance. Travel and accommodations are subject to availability and certain restrictions, blackout dates may apply. All travel must start and end within the United States. The Grand Prize Winner must provide hotel with a major credit card issued in his/her name to cover room security and incidental expenses. Sponsor assumes no responsibility for cancelled, delayed, suspended or rescheduled events (including airline flights) beyond its control. If the Grand Prize Winner lives within 200 miles of New York (as determined by Sponsor), Sponsor reserves the right to substitute ground transportation in lieu of airfare at its sole discretion, and any difference in value will not be awarded. The estimated retail value of each Grand Prize is $2,000.00. Total depending on Grand Prize Winner’s point of travel origin. Actual value will be determined by Grand Prize Winner’s residence and fare fluctuations. Any difference in amount between approximate retail value and actual value (if any) will not be awarded. Estimated retail value for each Grand Prize: $2,000.00.

    Total aggregate estimated retail value of all prizes (Second and Grand): $34,000.00.

  6. PRIZE WINNER SELECTION: Visual Arts Submissions from all eligible entries will be judged by a panel of high-profile collectors and art administrators, based on innovation, aesthetics and BOMBAY SAPPHIRE brand inspiration on or about November 3, 2012. All twelve (12) winning selections will be posted on the website at www.complex.com/sapphireart. From those twelve (12) winning selections, a subsequent panel of judges which may include Russell Simmons, Danny Simmons or other judges in the U.S. art industry will select two (2) Grand Prize Winners from the 2012 BOMBAY SAPPHIRE Artisan Series Finale Competition on or about December 9, 2012.

  7. Odds of winning any Prize depend on the number of valid entries received and the artistic value of each entry, as determined by the judges. By participating, entrants agree to be bound by these Official Rules and by the decisions of the judges, which are final and binding in all respects. Each Prize Winner will be required to execute an Affidavit of Eligibility, Liability Release and/or Publicity Release (where legal) to be returned within five (5) days of notification. Winners will be notified via e-mail or telephone. In the event of non-compliance with these requirements (including execution of the Affidavit of Eligibility, Liability Release and/or a Publicity Release) or if Prize notification/Prize is returned as undeliverable, Prize will be forfeited.

  8. All other expenses not specified herein are the sole responsibility of each Prize Winner. Taxes on all Prizes are solely the responsibility of each Prize Winner. No Prize transfer. Prizes are subject to availability. Sponsor may substitute a Prize of equal or greater value if any Prize becomes unavailable for any reason. Prizes are nontransferable, and no cash or other substitutions will be offered except at the sole discretion of Sponsor.

  9. GENERAL CONDITIONS:

    1. Only those entrants with completed Official Entry Forms containing the complete information described above will be entered to participate. Neither Sponsor nor any of its agencies are responsible for any telephone, technical, network, electronic, computer, hardware or software failures, malfunctions, or disconnects of any kind, or misdirected, illegible, incomplete, stolen or garbled, fragmented, or delayed Internet/e-mail computer transmissions or network/ISP/website/or internet accessibility; or for lost, late, damaged, delayed, destroyed, misdirected, incomplete, illegible, postage due entries/mail.

    2. ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE(S) OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.

      Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of this Contest or web site(s); to be in violation of the terms of service of the web site(s), to be acting in violation of these Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries by such methods. In the event of a dispute as to entries submitted by multiple users having the same e-mail account, the authorized subscriber of the e-mail account used to enter the Contest at the actual time of entry will be deemed to be the participant and must comply with these Official Rules. Authorized account subscriber is deemed to be the natural person who is assigned an e-mail address by an Internet access provider, on line service provider or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address.

      If, for any reason, the Contest is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of Sponsor, could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend this Contest for any drawing(s) and select the Prize Winners from Internet and mail-in entries received for that drawing prior to the action taken.

    3. By submitting a Visual Arts Submission as a part of an entry, you warrant and represent that your Visual Arts Submission is your own original work created by you, is true and verifiable, has not been previously published, has not won a previous prize or award, that you own or otherwise control all of the rights to your Visual Arts Submission and that your Visual Arts Submission does not violate any law, regulation or any right of any third-party, including but not limited to rights of copyright, publicity and privacy. Submitting an entry that is copyrighted by another individual will make you responsible for any legal action the legal copyright holder might take against you and/or Sponsor.

    4. By submitting a Visual Arts Submission as part of an entry, each entrant grants the Sponsor an exclusive right to reproduce, display, distribute and otherwise use the Visual Arts Submission (i) for any purpose whatsoever without compensation or further permission, including in all media (now known or later developed) for a period of one (1) year after the date of receipt by Sponsor and (ii) for Sponsor’s own internal use and in exhibitions of its historical advertising on a perpetual basis throughout the world in any media, now known or hereafter developed. Sponsor shall have no obligation to use any Visual Arts Submission in such manner.

    5. Visual Arts Submissions may not defame or invade the rights of publicity or privacy of any person, living or deceased, or otherwise infringe upon a person's personal or proprietary rights. Visual Arts Submissions that are deemed by the judges in their sole discretion to be immoral, obscene, profane or not in keeping with Sponsor's image will be disqualified. Further, Visual Arts Submissions that allude to over consumption or irresponsible drinking will not be considered. Sponsor reserves the right in its sole discretion to disqualify any Visual Arts Submissions or entry at any time which, in Sponsor's reasonable opinion, endangers the safety or well being of any person or in the event it is determined that the entrant has not complied with these Official Rules. In addition to the Sponsor’s right to do so in its discretion, the judges will also be instructed to disqualify any Visual Arts Submissions that describes dangerous conduct, stunts or tricks, conduct that could lead to physical injury, property damage or otherwise violates or is inconsistent with these Official Rules. Entries/ Visual Arts Submissions will be disqualified automatically if they do not satisfy all the requirements of these Official Rules. In the event that your contact information changes, it is your responsibility to notify the Sponsor of such changes.

    6. Employees of Sponsor, and its parent or any of parent’s affiliate companies, subsidiaries, agents, beverage alcohol distributors/ wholesalers, independent judging organization, retailers (including bartenders/staff) and their advertising and promotional agencies, and the employees/staff and the immediate families of each are not eligible to enter or win.

    7. Entrant releases Sponsor and its parents and parent’s affiliate companies, subsidiaries, alcoholic beverage retailers, independent judging organization, distributors/wholesalers and the directors, officers, employees and agencies of any of the above organizations, including Facebook, from any and all liability whatsoever for any injuries, losses or damages of any kind caused by participation in the Contest or resulting from acceptance, possession, or use/misuse of any Prize. By accepting any Prize, all Winners consent to the use of their names and likeness for advertising and trade purposes without additional compensation, except where prohibited by law. Participants waive the right to assert as a cost of winning any Prize, any costs of redemption or travel to redeem said Prize and any liability which might arise from redeeming or seeking to redeem said Prize.

    8. This Contest shall be governed by and interpreted under the laws of the State of Florida, U.S.A. without regard to its conflicts of law provisions. All entrants to this Contest agree that all disputes arising out of or relating in any way to this Contest shall be litigated only in courts sitting in Miami-Dade County, Florida, U.S.A.

  10. WHO WON: For the Prize Winners’ names in the 2012 BOMBAY SAPPHIRE Artisan Series Contest, send a self-addressed, stamped envelope to:
